Compass Group Enterprise Agreement 2017

The employer has applied to the Fair Work Commission (FWC) to approve the company agreement known as Compass Group – Medirest (Royal Victorian Eye & Ear Hospital) Enterprise Agreement 2018 (the Agreement). Mr. King (the Worker) was employed from August 25, 2016 to April 21, 2017 as Managing Director of PIA Mortgage Services Pty Ltd (PIAMS), a newly created part of the Property Investors Alliance (all employers). In April 2017, just before the employee took pre-authorized annual leave, the employer informed the employee that he would “park” his mortgage intermediation services and offered to terminate the worker`s employment relationship against payment of a four-month salary. The Full Bench of the Fair Work Commission overturned an earlier decision on the definition of “normal and habitual labour turnover” and found that a group of workers is not entitled to severance pay. On October 10, 2018, the employee was informed that he had tested positive for cannabis (78ug/L). He was suspended while an investigation was held to determine whether he had violated the employer`s directive on drugs and alcohol. The directive was recently amended in 2017 to promote a “zero tolerance” approach to drugs and alcohol and stated that test assessments must be below the cutting level set out in the Australia &New Zealand standard (50ug/L). In order for the Commission to do so, it is necessary to assess the terms of the proposed agreement against the terms of the applicable modern arbitral award. It is therefore essential that employers correctly identify the relevant modern price at the beginning of the bargaining process. .
